Pharmacy Benefit Manager Transparency Act of 2022

This critical legislation, endorsed by the National Community Pharmacists Association (NCPA),would enable the Federal Trade Commission (FTC) to hold PBMs accountable for unfair trade practices, increase PBM transparency, and help protect against PBM tactics that drive up healthcare costs for consumers. Specifically, S.4293 would:


  • Prohibit arbitrary financial “claw backs” and retro-active recoupments imposed by PBMs
  • Incentivize PBM transparency and reporting
  • Ban unfair trade practices including PBM spread pricing
  • Require PBMs to report how much money they make from spread pricing and fees
  • Allow the FTC (and states) to take legal action against PBMs and assess fees in the commercial health insurance market.
